Brussels has positioned itself as the global leader in AI governance, establishing risk-based categories, transparency requirements, and enforcement mechanisms that other jurisdictions are studying closely. Yet beneath the celebratory press coverage lies an uncomfortable truth: even this landmark regulation is already outdated, written for an AI landscape that has been transformed multiple times since drafting began in 2021.
The fundamental problem is temporal. AI capabilities are advancing on a scale of months; regulatory processes operate on scales of years. When the EU first proposed its AI framework, GPT-3 represented the frontier of language models. By the time the regulation passed, we had witnessed GPT-4, Claude, Gemini, and numerous other systems that redefined what AI could accomplish. Regulations carefully crafted to address 2021's concerns may be tangential to 2026's most pressing challenges. This gap is not unique to Europe—it reflects a structural mismatch between the pace of technological change and the deliberative nature of democratic governance.
Risk categorization exemplifies the challenge. The EU's framework sorts AI applications into risk tiers, with the highest scrutiny reserved for systems affecting fundamental rights, safety, and critical infrastructure. But emerging capabilities blur these categories in unexpected ways. A chatbot designed for customer service—low risk by initial classification—may be repurposed for mental health support where wrong advice could be life-threatening. General-purpose AI systems resist categorization entirely: the same model might help with homework, generate misinformation, assist medical research, or enable cyberattacks depending solely on how it's prompted.
The international fragmentation compounds these difficulties. While the EU has moved toward comprehensive regulation, the United States has opted for sector-specific guidance and voluntary commitments. China has developed its own regulatory framework emphasizing content control and state interests. This patchwork creates compliance complexity for multinational companies while providing no coherent global governance for AI systems that operate across borders by their nature. The internet taught us that digital technologies resist jurisdictional boundaries; AI is teaching the same lesson with greater urgency.
Industry influence over regulatory processes deserves scrutiny. Major AI companies have invested heavily in government relations, positioning themselves as indispensable experts while advocating for frameworks that preserve their competitive advantages. Revolving doors between technology companies and regulatory agencies raise questions about whether rules truly serve public interests or incumbent business models. The resulting regulations often focus on transparency and process requirements that large companies can readily satisfy while imposing disproportionate burdens on smaller competitors and researchers.
Some argue that regulation should wait until the technology stabilizes, allowing market forces and voluntary standards to guide development. This view underestimates the risks of AI systems already deployed at scale—hiring algorithms that perpetuate discrimination, surveillance tools that enable authoritarian control, information systems that amplify polarization and misinformation. The costs of inadequate governance are being paid now by individuals and societies that had no voice in AI development decisions.
A more honest assessment would acknowledge that perfect AI regulation may be impossible given current constraints. What we need instead is adaptive governance—regulatory frameworks designed for continuous learning and adjustment, with mechanisms to incorporate new evidence and respond to emerging risks. This requires different institutional capabilities than traditional rulemaking: continuous monitoring, rapid response authority, meaningful stakeholder participation, and international coordination.
